credit: give me liberty

One cannot claim to be a defender of the Constitution with words alone and expect to be believed.  More is required, such as when you want to do something, but know it’s unconstitutional, not only do you not do it, you don’t mention it.  And you absolutely do not let your minions try to figure out sleazy ways around the Constitution.  This is particularly important when you’re the President Of The United States, and you’ve taken this oath, which by remarkable coincidence is in Article II of, you guess it, the Constitution:

I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.

Note the “…preserve, protect and defend the Constitution of the United States” part, which is again a remarkable coincidence in that part of the Constitution is the Bill of Rights, which acknowledges, but does not grant, individual liberties, and by another amazing coincidence, contains the 10th Amendment, which speaks to the powers of the states, which are sovereign political entities and all that other annoying and outdated constitutional stuff.

D/S/Cs constantly accused Donald Trump of being a dictator, of violating “norms,” and “standards,” and of tearing down the Constitution.  Yet when it came time to put up or shut up, when it came time to actually prove their accusations, despite tens of millions spent and two impeachments—one when Trump had already left office—they proved only their accusations were lies.  For a man accused of unlimited high crimes and misdemeanors, there was no evidence to prove one.  In a sane country with actual public servants in office, that wouldn’t be the case where Joe Biden is concerned, as Brietbart.com reports:

President Joe Biden ordered widespread vaccination mandates on Thursday, demanding that private businesses mandate vaccinations for their employees.

‘This is not about freedom or personal choice,’ Biden said during a speech from the White House. ‘It’s about protecting yourself and those around you.’

Terribly sorry Gropin’ Joe, but America is about freedom and personal choice, and you don’t get to define their limits.

Biden used a sharper tone against unvaccinated Americans, lecturing them for refusing the vaccine.

‘We’ve been patient, but our patience is wearing thin,’ he said.

Excuse me?!  From where, exactly, does the royal “we” come?  I can assure Mr. Biden the patience of “we”—Normal Americans—has long been exhausted where he and his handlers are concerned.  As has become the new “norm,” elected officials no longer understand who employs them, and they’re damned snotty about it.  They’re about to find out.

The president said he ‘understood’ why vaccinated Americans were angry about the continued rise in cases around the country.

‘Many of us are frustrated with the 80 million Americans who are not vaccinated,’ Biden said.

No, Joe, Normal Americans understand we’re dealing with a virus, which is, from this day forward, always going to be with us.  We also understand unless we’re quite elderly and have other dangerous medical conditions, the survival rate is 99 point-something percent, which does not constitute an “emergency” by any possible definition of the term grounded in reality/science. What Americans are frustrated about is your stupidity, arrogance and utter incompetence in dealing with this, and every other issue of consequence in the eight months of your term of destruction of America.  Most of all, they’re upset with your increasingly unlawful, arguably tyrannical actions.

The plan released by the White House noted the Department of Labor’s Occupational Safety and Health Administration (OSHA) would develop a rule requiring all private companies with 100 or more employees to make sure their employees were fully vaccinated or produce weekly negative test results.

‘We’re going to protect vaccinated workers from unvaccinated co-workers,’ Biden said.

What?!  Biden just told America vaccines don’t work!  If you’re vaccinated, you’re supposed to be immune, you have no need to worry about the unvaccinated, and if you’re not, Biden just told America there’s no point in getting vaccinated.  And of course, there is no recognition of the fact, the science, that those who survived the virus have immunity as good as, and  likely superior to, that conferred by vaccines.  This also raises the question of what happens when everyone is vaccinated?  Do all the mandates, masks and related idiocy go away?  Ever?  And does OSHA have the authority to do what Biden is demanding?  Does Biden?  Former federal prosecutor Andrew McCarthy, at National Review, explains:

I agree with our excellent editorial on Biden’s illegal vaccine mandate. I wish only to reassert an additional, fundamental constitutional objection — the same one I posited, as did Charlie, in connection with Biden’s illegal eviction moratorium. It is unconstitutional.

There is no general federal health-care power. The constitutional exhortation for Congress to ‘provide for . . . the general Welfare of the United States’ (art. I, sec. 8) is not an open-ended authorization. Ours is a federalist system, the states presumptively govern their internal affairs, and Congress’s power to provide for the general welfare is cabined by its enumerated powers.

Yeah, it’s that whole non-woke “limited government” thing.  That’s soooo 1788 (the year the Constitution was ratified).

 To put it starkly, if the president may order a medical mandate because the federal government (and not the executive, mind you) is supposed to provide for the general welfare, then is there anything the federal government may not do? Is there anything left of the federalist principle that states are sovereign regarding their internal affairs? Absent the assurance of that principle’s vitality, the Constitution would never have been ratified. [emphasis mine]

He [Biden] noted the ‘vast majority’ of Americans were ‘doing the right thing’ by getting vaccinated, but that he would make life more difficult for the unvaccinated.

And here we see the reality of the moderate, compassionate, experienced Joe Biden, the man who was going to be the adult in the room, who would restore the normal, make the world love America again and unite all Americans.  Joe Biden is an angry, cruel, narcissistic, mentally compromised old man, a man who cares only about himself, and perhaps his family–so long as they keep bringing in the bucks.  The President of the United States is going to punish tens of millions of Americans for refusing to do as he says.  Boy howdy will that unify everybody! It’s interesting to note Biden’s mandates are estimated to affect some 80 million Americans, which by an amazing coincidence is the number of Americans supposedly not yet vaccinated.  What no one is noticing is the people not yet vaccinated are not the people Biden thinks they are.  They’re not all white supremacist, domestic terrorist, insurrectionist, systemically racist Trump voters.  The number of unvaccinated Black and Hispanic Americans is higher than white non-Biden voters, and a great many of the unvaccinated are medical professionals and public employees such as police officers and firefighters.

Indications are as many as 40% of those Biden is targeting will resign their jobs rather than submit.  What happens to hospitals, police agencies, fire departments, etc. then? Hmmmm.  Perhaps Biden’s handlers didn’t think this one through, or don’t care?

Biden is also mandating vaccination for federal employees—except postal employees?!  Why would he do that?  It’s simple.  It’s payback for their service in helping him cheat his way into office.  Postal employees were instrumental in ballot fraud, and will need to be in 2022 and 2024.  But it now appears after what had to be an overwhelming backlash, postal employees are going to be on the jab list too–maybe. They won’t like that.  I wonder what they’re going to leak in the days to come?  But it gets even better:

He warned state governors who threatened to oppose his more draconian mandates that he would use his executive powers to enforce them.

‘If these governors won’t help us beat the pandemic, I’ll use my powers as president to get them out of the way,’ he said.

What the hell?!   This is B-movie Mafia dialogue.  Will FBI leg breakers be paying resistant governors a little visit?  Nice little state youse got here.  Be a shame anyting wuz to happen to it.  And what powers does the Constitution give any president to get governors “out of the way?”  Has Joe repealed the 10th Amendment?  Actually, he doesn’t have to repeal it, he’s violating that and surely the intent of the Constitution, even after admitting he knows he’s violating it.  This was the best part:

God bless you all and all those that continue to serve on the front lines of this pandemic. And may God protect our troops. Get vaccinated.

For the last sentence, Biden leaned forward into the microphone and whispered “get vaccinated,” in that creepy, threatening C-horror movie croak he’s recently adopted, and immediately thereafter, turned and fled, without reading aloud: “I’m supposed to leave without taking questions now.”  He and his handlers are, of course, far too tone deaf to realize how enraging is Joe Biden saying anything about protecting our troops after he got 13 killed, and only hours before 9-11.  Normal Americans know, and they won’t forget. Former Navy SEAL and Texas Representative Dan Crenshaw knows too:

But hey, at least Joe’s being consistent…isn’t he?

…it’s worth reminding you that it was less than a year ago—eight months, in fact—that Joe Biden opposed both vaccine and mask mandates.

‘No, I don’t think it should be mandatory. I wouldn’t demand it be mandatory,” Biden said of vaccines. “But I would do everything in my power — just like I don’t think masks have to be made mandatory nationwide — I will do everything in my power as president of the United States to encourage people to do the right thing. And when they do it, demonstrate that it matters.’

Biden spokesliar Red Jen Psaki, more recently confirmed such mandates are not the business of the Federal Government, and so did a mentally declining Nancy Pelosi. Silly me.  I almost thought Joe was telling the truth for a moment. SMM takes you now, gentle readers, to one of those governors Joe is going to swat out of the way with his mighty hand:

[Gov. Kristi] Noem [of South Dakota] told Fox News Channel’s Sean Hannity her administration, as well as other governors around the country, would take action against the Biden administration.

‘[I] think we have 14 different governors that have now said they will take some kind of action,’ she said. ‘As for South Dakota, I’ll fight to protect my people and to defend their freedoms. In fact, it has shocked me that the president actually said in his speech today that this wasn’t about freedom and personal choice at all, which I think is indicative of what’s really in his heart and his agenda that he’s got for this country.’
‘Listen, this is not a power that is delegated to the federal government,” Noem continued. ‘This is a power for states to decide. In South Dakota, we’re going to be free, and we’re going to make sure that we don’t overstep our authority. So, we will take action. My legal team is already working, and we will defend and protect our people from this unlawful mandate.’

Overall, Noem said Biden’s presidency thus far left much to be desired.

‘He’s a huge hypocrite,’ she added. ‘He said he created jobs, and he’s destroying jobs. He’s said he’d love America and protect us, and then he makes friends with the Taliban and compromises our southern border. It’s unbelievable to me what he is doing. I knew he’d wreck this country. That’s why I campaigned so hard for President Trump. I had no idea anyone alive could wreck this country as fast as Joe Biden is.’ [emphasis mine]

At the New York Post, Andrew McCarthy adds a bit more pertinent legal detail:

Clearly, President Joe Biden is not chastened by the Supreme Court smackdown he got just a couple of weeks ago, when the justices invalidated the eviction moratorium that even administration officials acknowledge was patently lawless right before Biden reissued it.

Quite the opposite.

The administration is similarly well aware that the national vaccine mandate that the president is poised to issue is unlawful. White House Chief of Staff Ron Klain made the obvious explicit by retweeting a progressive commentator’s observation that the ploy of imposing the vaccine requirement as a workplace-safety rule under OSHA (the Occupational Safety and Health Administration) is the ‘ultimate work-around.’

Translation: The president knows that an executive order mandating COVID vaccination would be shot down instantly, so he’s trying to camouflage it in a maze of Labor Department regulation.

Even on that score, the gambit cannot be justified. OSHA is trying to evade the Administrative Procedure Act’s requirement of a regulatory commentary period by slamming the vaccine dictate through as an ‘Emergency Testing Standard.’

It has been nearly 40 years since OSHA tried that trick . . . mainly because the courts struck it down, on an asbestos regulation, in 1983.

Final Thoughts:

Covid is no emergency.  It’s long been downgraded from pandemic to endemic status and we’re learning more about the fraud of Covid reporting, dishonestly expanding the actual number of cases and deaths.  So what’s really going on here?  The White House has been humiliated by their own Afghanistan debacle.  We can’t be sure any of them are capable of feeling shame, but they are scared to death by the potential loss of political power.  They can’t—won’t—punish the Taliban or any of America’s enemies, but they can surely try to harm their domestic enemies, or those they imagine to be enemies anyway.  Hell, they’re all racist, white supremacist, domestic terrorist, insurrectionist haters anyway.  They deserve it.

And of course, this is the classic D/S/C tactic of distraction.  They’re not going to do anything about the border but make it worse.  The same for the economy, the American hostages they stranded behind enemy lines, and all the other damage they’ve done to the country in only eight months.  In his bizarre 9-11 recorded address, Joe kept talking about unity, but this is the kind of unity he delivers.  Not only does he purposely divide Americans, he tries to keep them at each other’s throats—black against white, vaccinated against unvaccinated, women against men–the better to divert attention from his continuing destruction of this nation.

Let us not forget if Biden was really concerned about Covid, he wouldn’t be letting unvetted, infected hundreds of thousands across our Southern Border, nor would be he flying unvetted, infected tens of thousands into America.   All of these vectors of contagion–including confirmed cases of measles among Afghan(?) fly-ins–are being resettled across America, without the knowledge or consent of Americans. In fact, the Administration has declared vaccination is only for Americans, not the unknown, infected hordes they’re allowing into the country.  For D/S/Cs, actually doing the jobs they’re elected and hired to do is hard and disgusting.  Serve Deplorables?  Hell no!  That takes real work.  But punishing innocent Americans?  They have plenty of underlings more than willing to do that.  That takes no work at all and is much more fun in the Conanian sense:

Conan, what is best in life?’

‘To crush your enemies, see dem driven before you, and hear the lamentation of da vimen!’

If government can force us to take a medication, where are its limitations?  What can’t we be forced to do?  If government can deprive us of the ability to make a living—The Supreme Court long ago ruled we have a 4th Amendment property interest in our jobs—if it can decide to make our lives difficult just because, do we any longer live in a constitutional republic?

What have we become that we countenance our “leaders” issuing mandates they know to be unconstitutional—illegal—after they’ve admitted they know it’s illegal?  I guess that’s a trick Biden learned from Obama.The problem isn’t the Taliban, it’s those evil, white supremacist, domestic terrorist, insurrectionist, racist unvaccinated, and Biden’s patience is exhausted.  He’s mad as hell and he isn’t going to take it anymore, and to hell with the Constitution!  Our national doctor, Joe Biden, is killing the patient and declaring glorious victory.  Hmm.  That sounds vaguely familiar…
