The foundation of liberty is the unalienable right to self-defense.
Thomas Cahill, in his exceptional The Gifts Of The Jews, argues the idea of the inestimable worth of the individual began with God’s covenants with the Jews. If every woman and man is equal in the sight of God, if their souls are equally valuable, how can the preservation of their lives be inconsequential? How can their continued existence be determined by the whims of government? This is why self-defense is an unalienable right. Unalienable rights, also known as natural rights, are granted by the Creator, not government, and may not legitimately be taken away by government.
Democrats/Socialists/Communists know this, which is why they so hate the Second Amendment and the Deplorables that insist on it. When Americans who can read plain English exercise their First Amendment right—D/S/Cs hate that too—to observe the Second Amendment was written not just for self-defense, but to allow free men and women to rise up to oppose tyranny should it become necessary, D/S/Cs blow their tops. They accuse them of being un-American and even of committing treason—classic projection.
Normal Americans are far smarter than D/S/Cs imagine. They understand D/S/Cs are intent on disarming them. They know the only way that can happen is if federal agents descend on Americans to take their weapons at gunpoint. They also know that will end badly—very badly—for everyone and would surely provoke a hot second civil war.
At one time the D/S/C Party was more or less an American party, however it shifted far more toward Communism than to traditional American values/policies. Before that shift, many Democrats were American constitutionalists. Today, few are. Oh, but many say they honor the Constitution! Do their votes reflect that?
With that in mind, let us visit Joe Biden’s campaign website. The section on guns is very lengthy, a clear indication of D/S/C’s obsession with disarming the law-abiding. It’s so lengthy I’m only going to discuss portions of it. What I’m sure will become obvious is Biden’s policies are not aimed at criminal misuse of firearms or public safety, but at disarming the law-abiding.
The prisoners of a tyranny—despots build walls to keep people in, not out—can never have a right to self-defense or the means to affect it. They live at the sufferance of the self-imagined elite, the “scientific” socialists and communists. The first sign of an impending tyranny is the abolition of the right to keep and bear arms, and with it, the right to self-defense. One need not know a great deal about history to understand that.
Electing Joe Biden will be the death of the Second Amendment, and with it, the rest of the Bill of Rights. One might reasonably observe Biden has little clue what’s actually on his website, but we can be certain those actually behind his campaign, those that will actually run his presidency, know, and know he will gladly do their bidding, not only because of his rapidly diminishing mental capacity, but because he has a long history as an anti-liberty/gun cracktivist.
If you have no right to self-defense, what other right matters?
Think I’m exaggerating? On to his website and his introduction:
Joe Biden knows that gun violence is a public health epidemic. Almost 40,000 people die as a result of firearm injuries every year in the United States, and many more are wounded. Some of these deaths and injuries are the result of mass shootings that make national headlines. Others are the result of daily acts of gun violence or suicides that may not make national headlines, but are just as devastating to the families and communities left behind.
As we continue, keep in mind the idea of a “public health epidemic.” I’ll address it later. It’s a cheap attempt to steal individual liberty justified by a “public health emergency.” Sound familiar?
Hold gun manufacturers accountable. In 2005, then-Senator Biden voted against the Protection of Lawful Commerce in Arms Act, but gun manufacturers successfully lobbied Congress to secure its passage. This law protects these manufacturers from being held civilly liable for their products – a protection granted to no other industry. Biden will prioritize repealing this protection.
If successful, this alone will be a crippling step against the Second Amendment. As usual, Biden is lying. The PLCAA only prohibits nuisance lawsuits against gun manufacturers. In 2005, anti-liberty/gun cractivists hit on the strategy of attacking gun manufacturers with a blizzard of nuisance lawsuits, which, if allowed to continue, even if none of them won in court, would bankrupt manufacturers. The cost of defending against the lawsuits—we now call this Lawfare—would have overwhelmed profits and no new guns, ammunition or accessories would have been produced. This was the goal of people like Biden, a backdoor attack on the Second Amendment, which would still exist, but have no practical meaning.
The distinction is those suits did not allege injury due to faulty products. They were suing manufacturers for marketing legal, non-defective products, and singling out the gun industry alone. The PLCAA only prevents suits against legal, non-defective products, which is the state of tort law for every other lawful product on the market. If a gun manufacturer makes a defective product, which injures someone, those suits are allowed. D/S/Cs know this, but they’ll always lie to get their way.
Get weapons of war off our streets. The bans on assault weapons and high-capacity magazines that Biden, along with Senator Feinstein, secured in 1994 reduced the lethality of mass shootings. But, in order to secure the passage of the bans, they had to agree to a 10-year sunset provision and when the time came, the Bush Administration failed to extend them.
Another grotesque lie. The Clinton Gun Ban, as it was known, had no effect at all on public safety. This was so obvious, even many Democrats of the time did not support reauthorizing the law when it sunset. Having many of their colleagues turned out of office for their support of the ban also had a sobering effect. However, D/S/C policies are non-falsifiable; they cannot possibly be wrong. So when they fail, this must be so because they weren’t in effect long enough for their wonders to manifest—a decade is obviously not nearly long enough—they weren’t sufficiently restrictive, not enough money was spent, or worst of all, Normal Americans were allowed to exist to oppose them.
Ban the manufacture and sale of assault weapons and high-capacity magazines. Federal law prevents hunters from hunting migratory game birds with more than three shells in their shotgun. That means our federal law does more to protect ducks than children. It’s wrong. Joe Biden will enact legislation to once again ban assault weapons. This time, the bans will be designed based on lessons learned from the 1994 bans. For example, the ban on assault weapons will be designed to prevent manufacturers from circumventing the law by making minor changes that don’t limit the weapon’s lethality. While working to pass this legislation, Biden will also use his executive authority to ban the importation of assault weapons.
More lies. Shotgun magazine limits are designed to help prevent hunters exceeding their bag limits; they’re a conservation measure. Dishonest politicians always invoke “the children” when their policies are insupportable. In order to achieve the goal Biden wants, it will be necessary to ban essentially every semiautomatic firearm, which is the single defining characteristic Biden seeks to ban. D/S/Cs currently consider a “high-capacity magazine” to hold 11 or more rounds. If they get this ban, they will surely decide public safety requires no more than five rounds, actually, no rounds at all. He’ll do away with domestic manufacture, and also eliminate foreign manufacture.
Regulate possession of existing assault weapons under the National Firearms Act. Currently, the National Firearms Act requires individuals possessing machine-guns, silencers, and short-barreled rifles to undergo a background check and register those weapons with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Due to these requirements, such weapons are rarely used in crimes. As president, Biden will pursue legislation to regulate possession of existing assault weapons under the National Firearms Act.
The NFA regulates machineguns and suppressors, and put overall length and barrel length restrictions on rifles and shotgun. A rifle with a 16” barrel is legal. One with a 15.999” barrel is a federal felony. Registration of such weapons does not prevent crimes, rather, it is the fact that owners of such weapons are unusually law abiding and willing to submit to onerous, unnecessary government vetting. Biden doesn’t mention one has to be fingerprinted, photographed, and pay a $200 dollar non-transferable tax for each weapon or suppressor, a process that can take up to a year. Imagine how long that process would be for this boondoggle. In a D/S/C administration, the length of the process would become de facto gun prohibition. In addition, The NRA, via Breitbart, estimates AR-15 owners would pay in the area of $.3.6 billion dollars in taxes for this provision alone. It would be much more when D/S/Cs expand the definition of “assault weapon” beyond AR-15 like arms and if they decide to require registration for every magazine (they surely will). Current federal law prohibits any federal gun registration scheme, so it will be necessary to repeal that law. The only reason for a gun registry is to aid confiscation, as you’ll momentarily see.
One additional note: In US v. Haynes, the Supreme Court ruled felons cannot be prosecuted for failing to register guns. It would be a violation of their 5thAmendment right against self-incrimination. As is always the case, D/S/Cs are interested only in criminalizing the law-abiding; criminals, as always, get a pass from D/S/Cs.
Buy back the assault weapons and high-capacity magazines already in our communities. Biden will also institute a program to buy back weapons of war currently on our streets. This will give individuals who now possess assault weapons or high-capacity magazines two options: sell the weapons to the government, or register them under the National Firearms Act.
A “buy back” is gun confiscation by another name. The government certainly will not fairly compensate gun owners:
Bureaucrat: “Here’s your authorized $200.”
Honest Citizen: “But my AR cost $2300!”
Bureaucrat: “Shut up you racist.”
Few Americans will comply with this, which means the Federal Government will try to enlist local law enforcement to go door to door seizing guns. Most will not comply, which means a massive increase in federal agents, huge piles of dead Americans, and the beginning of the Second—hot—Civil War.
Reduce stockpiling of weapons. In order to reduce the stockpiling of firearms, Biden supports legislation restricting the number of firearms an individual may purchase per month to one.
Really? Americans can buy 12 guns a year? That’s not “stockpiling?” This is just another harassment mechanism aimed at the law-abiding. D/S/Cs have long advocated eliminating “arsenals,” which they have always defined as very few firearms and very few rounds of ammunition.
Close the ‘hate crime loophole.’ Biden will enact legislation prohibiting an individual ‘who has been convicted of a misdemeanor hate crime, or received an enhanced sentence for a misdemeanor because of hate or bias in its commission’ from purchasing or possessing a firearm.
As with every “loophole” D/S/Cs seek to “close,” this is a fraud. There is no such loophole, because rational legislators have not yet made everything D/S/Cs don’t like a hate crime. They plan to remedy that, which will essentially eliminate the First Amendment’s free speech provisions. Do we want to revoke American’s unalienable rights for misdemeanors? D/S/Cs do, and keep in mind it’s virtually impossible to get through a day without violating some misdemeanor. D/S/Cs will make it absolutely impossible.
End the online sale of firearms and ammunitions. Biden will enact legislation to prohibit all online sales of firearms, ammunition, kits, and gun parts.
Another lie. One may buy a gun from an Internet vendor, but it must be sent to a local, federally licensed gun dealer who, for a fee, does all the required federal paperwork and background checking. There is no public safety benefit from prohibiting the sale of ammunition and parts, but it would certainly further efforts to disarm the public. The deviltry is in the definitions. “Parts” would surely be any and everything remotely related to guns.
Create an effective program to ensure individuals who become prohibited from possessing firearms relinquish their weapons. Federal law defines categories of individuals who are prohibited from purchasing or possessing firearms, and the federal background check system is an effective tool for ensuring prohibited persons cannot purchase firearms. But we lack any serious tool to ensure that when someone becomes newly prohibited – for example, because they commit a violent crime – they relinquish possession of their firearms. There are some promising models for how this could be enforced. For example, California has a mandatory process for ensuring relinquishment by any individual newly subject to a domestic violence restraining order. As president, Biden will direct the FBI and ATF to outline a model relinquishment process, enact any necessary legislation to ensure relinquishment when individuals newly fall under one of the federal prohibitions, and then provide technical and financial assistance to state and local governments to establish effective relinquishment processes on their own.
Right. The federal government is going to subvert local authority to enforce misdemeanors and do it themselves. The Federal government cannot dragoon state and local law enforcement into enforcing federal law–yet—but they can withhold funds and harass them in a variety of other ways. With a packed Supreme Court, anything is possible. And when someone makes a mistake and the federal confiscation police kill innocents…
Give states incentives to set up gun licensing programs. Biden will enact legislation to give states and local governments grants to require individuals to obtain a license prior to purchasing a gun.
A license. To exercise an express, unalienable liberty? See the previous comment for how they’ll do that. Any guesses on how expensive such “licenses” will be, or how long it will take to grant one? Any bets on whether the licensing system will be “shall grant” or “may grant?”
Put America on the path to ensuring that 100% of firearms sold in America are smart guns. Today, we have the technology to allow only authorized users to fire a gun. For example, existing smart gun technology requires a fingerprint match before use. Biden believes we should work to eventually require that 100% of firearms sold in the U.S. are smart guns. But, right now the NRA and gun manufacturers are bullying firearms dealers who try to sell these guns. Biden will stand up against these bullying tactics and issue a call to action for gun manufacturers, dealers, and other public and private entities to take steps to accelerate our transition to smart guns.
It’s hard to count the lies and misleading assertions in this one. I last addressed so-called “smart guns” in May of 2019, here. There is no such reliable, feasible, affordable technology, which is precisely why D/S/Cs want to mandate it; it’s just one more way to entirely eliminate guns. Fingerprint recognition? What about dirty hands or gloves? No one is bullying anyone; Americans simply won’t buy unreliable, grotesquely overpriced guns. Take the link to see actual reality.
Hold adults accountable for giving minors access to firearms. Biden supports legislation holding adults criminally and civilly liable for directly or negligently giving a minor access to a firearm, regardless of whether the minor actually gains possession of the firearm.
And how would this one be enforced, exactly? Obviously, it would require wholesale violations of the Fourth Amendment. If a second grader told teacher daddy had a gun, bye bye daddy! It would also render all guns utterly useless for self-defense, in the home and otherwise. But what better way to indoctrinate future generations than to put their parents in jail and sue them into poverty so kids can be seized from “unfit” parents. And notice the last clause. D/S/Cs intend to advance criminal justice into prosecuting future thought/potential crime. Real offenses will no longer be necessary. What’s that you say about “presumption of innocence?” You obviously hate children and the government, you racist!
Require firearms owners to report if their weapon is lost or stolen. Responsible gun owners have a responsibility to inform law enforcement if their weapon is lost or stolen. Biden will enact legislation to make this the law of the land.
Right. Enforced by the federal government. Imagine the size of a new federal bureaucracy to enforce this, which will be necessary when all local police are abolished or effectively emasculated. I’m sure trifles like a gun owner not realizing their gun was stolen won’t matter. We must protect the children!
Reform, fund, and empower the U.S. Justice Department to enforce our gun laws. Biden will direct his Attorney General to deliver to him within his first 100 days a set of recommendations for restructuring the ATF and related Justice Department agencies to most effectively enforce our gun laws. Biden will then work to secure sufficient funds for the Justice Department to effectively enforce our existing gun laws, increase the frequency of inspections of firearms dealers, and repeal riders that get in the way of that work.
Of course, because there is nothing we need more than an enormous, all-powerful, federal anti-liberty/gun police force with no annoying “riders”—constitutional restrictions that preserve individual liberty.
TACKLE URBAN GUN VIOLENCE WITH TARGETED, EVIDENCE-BASED COMMUNITY INTERVENTIONS. Daily acts of gun violence in our communities may not make national headlines, but are just as devastating to survivors and victims’ families as gun violence that does make the front page. And, these daily acts of gun violence disproportionately impact communities of color. But there is reason to be optimistic. There are proven strategies for reducing gun violence in urban communities without turning to incarceration. For example, Group Violence Intervention organizes community leaders to work with individuals most likely to commit acts of gun violence, express the community’s demand that the gun violence stop, and connect individuals who may be likely perpetrators with social and economic support services that may deter violent behavior…
Riiiight: “What’s that? The community demands gun violence stop? You’ll connect me with social and economic support services? Why of course you may have my stolen and illegally altered guns. Please step inside and take the 20 keys of cocaine and all the other illegal drugs I’m packaging for sale. Oh, and since the community wants me to stop, I’m going to call off the murders I’ve ordered, free the women and girls I’m holding in sex slavery, and totally give up my life of crime and work at McDonald’s for minimum wage,” said no gang banger or other criminal, ever.
“But what about arresting these people for their innumerable violent crimes and putting them in jail forever, so they can’t harm the community?”
“Shut up you racist.”
Dedicate the brightest scientific minds to solving the gun violence public health epidemic. In 2013, President Obama issued a memorandum clarifying that a longstanding appropriations rider that prohibited the Centers for Disease Control and Prevention (CDC) and other federal scientific agencies from using federal dollars to ‘advocate or promote gun control’ does not prohibit those agencies from researching the causes and prevention of gun violence. The National Institutes of Health (NIH) subsequently embarked on funding some of this research, though Republican leadership in Congress refused to appropriate any funds to the CDC for this work. Biden will call for Congress to appropriate $50 million to accelerate this research at the CDC and NIH.
Of course. The criminal misuse of any kind of weapon is a public health issue! I’m sure wrongthink will quickly become the same. And I’m equally sure the CDC and NIH will be unbiased, and report that viruses and crime are not quite the same thing and require entirely different approaches. After all, they’re scientists, so they know all about what’s best for everyone. I’ll produce scientific sounding, anti-liberty propaganda for $1 million tops. Just give me a call, Joe.
Prohibit the use of federal funds to arm or train educators to discharge firearms. We should be passing rational gun laws, not requiring educators who already have too much on their plates to also protect the safety of their students. Biden supports barring states from using federal dollars to arm or train educators to discharge firearms.
If you’ve been reading my series on school attacks—enter “School Attacks 2020” in the SMM home page search bar–you know just how dangerous, and insane, this is. At D/S/C’s urging, school districts are totally eliminating police presence in their schools. But that’s not enough. They also want to ensure teachers and kids are completely helpless. Fortunately, gun training can be done on the local level for very little money, but I’m sure they’ll try to eliminate that too. After all, it’s for the children!
Final Thoughts: If you’re getting the idea their policies have nothing whatever to do with reducing crime and disarming criminals or with public safety generally, you’re on the right track. Every policy Biden is proposing would disarm only the law-abiding, normal Americans who are no threat to anyone, and who, seeing their policies and their support for lawlessness and destruction, understand more than ever when it comes to protecting their lives and property, they’re on their own. If Joe Biden is elected, and he’s able to enact these, and other more onerous, policies, he will be forcing a confrontation with Americans that can lead only to civil war. Many other things he proposes will destroy our constitutional republic, but these alone are more than sufficient reason to vote against Biden. Why vote for anyone who advocates eliminating any part of the Bill of Rights?
In my way of thinking, the notion of “smart gun” tech is like anti-gravity tech. I am not exactly against it, but do not expect me to rush to choose it over a perfectly good parachute when it comes time to jump out of an airplane.
There are still deep problems. Any kind of RFID/magnetic signal is just another lock & key combination and is is no way personalized. And there are already multiple ways to mechanically lock and unlock any firearm that get the job done without batteries, etc.
A “biometric” system, to be taken seriously, would need to work reliably without any physical contact. No one I know has even the slightest clue how to do that. In fact, if such capability were to be invented, it would be used everywhere for ID purposes. It would worth be a trillion dollars. So, it is not “politics” that stands in the way.

Excellent point. If such a technology actually worked anywhere outside of movie scripts, it would be a gold mine for its inventor and manufacturer. But of course, it does not exist, and there is no indication it ever will.
“Biometric” security systems have been tried at highly secure military facilities, such as Schriever AFB, CO, and were a disaster. Retina and fingerprint scanners failed most of the time, severely delaying entry of authorized personnel, and were finally abandoned.
Biden’s naive “smart gun” plan is merely a smoke screen and cover for citizen disarmament, as you’ve so astutely argued, Mike. Many thanks!

Societies like ours do not last historically. A flood of people fleeing another country results in a collection of socialists who want to ride while defended by others. And when one loses a free press, we are almost done from misinformation. No nation has ever survived. A revolution to defend our Constitution will be the likely result. Without it we would not have the right to protect ourselves and support the 3rd amendment. The 3rd amendment. Read it.

You’re quite right. Our experiment is unprecedented and rare. Peace and prosperity are not the status quo of mankind, and we’ve had a great run. What’s most tragic is all we have to do to maintain our constitutional republic is accept American constitutionalism. We have to be able and willing to say: “that might be a good idea, but the Constitution forbids it, so we can’t do it.” Sadly, something under half of the nation is apparently unwilling.
